The Importance of Guanxi to Chinese Civilization

In lieu of a Western style legal system for most of China’s history, Guanxi offered an alternative to foster innovation, develop trust and contribute to trade and commerce for thousands of years.

Sir Robert Hart (1835 – 1911), the godfather of China’s modernization and the main character of my first two historical fiction novels, discovered the importance of Guanxi soon after he left the employ of the British and went to work for the Emperor.

In addition, Hart wrote in a letter in 1891, “These people (referring to the Chinese) never act too soon, and, so far, I have not known of their losing anything by being late. To glide naturally, easily and seasonably into the safe position sequence as circumstances make, is probably a sounder though less heroic policy for a state than to be forever experimenting—”

To translate, it takes time to develop a relationship/friendship/trust (Guanxi) that all invovled may benefit from.

However, I did not learn about Guanxi from Robert Hart. I first learned of it from the China Law Blog, which quoted the Silicon Hutong Blog.

Then I did more research and watched a few videos on the subject. I learned that Guanxi is one of those complexities of Chinese
culture that does not translate easily.

There are several elements and layers to Guanxi. First, Guanxi is based on a Confucian hierarchy of familial relationships, long-term friendships, classmates, and schoolmates and to those no stranger – Chinese or foreign – will ever have access. Source: Silicon Hutong

Guanxi developed over millennia because China did not have a stable and effective legal system as it developed in the West.

In fact, the legal system in China today is relatively new and made its appearance after the 1982 Chinese Constitution became the law of the land.

Since 1982, there have been several amendments to the Constitution as China adapts its evolving legal system, which was modeled after the German legal system.

In time, this Western influenced legal system may replace Guanxi since business law modeled on Western law with Chinese characteristic has developed faster than civil law.

There are a several opinions about Guanxi. I learned that Guanxi is similar to a gate that opens to a network of human beings but it isn’t that simple.

Maintaining Guanxi is different than how relationships are maintained in other cultures. The embedded videos with this post offer a more detailed explanation.

The Real Police State (1/4)

China is a culture that has never gone easy on convicted criminals. When I was researching 19th Century China for Robert Hart’s Concubine Saga, there was an incident in Canton that Hart wrote about where the Chinese Imperial government had fifty Chinese randomly selected from a street near a gate where rebels had broken into the city. 

Those fifty were beheaded without a trial to show others what would happen if a similar incident took place. The heads were put in cages where the people could see them as a reminder.

More than a century later, the BBC and Wondering China reported that China’s highest law-making body would debate a draft amendment to criminal law soon to reduce the number of crimes that carry the death penalty.

A brief history of China’s legal system shows that when Mao died, there was no legal system in place at the time. In the 1980s, during the infancy of China’s legal system, the lower courts could apply the death penalty, but the numbers executed caused Westerners to protest the inhumanity of such acts.

As a result, in 2007, the law changed and death sentences had to be reviewed by a higher court before gaining approval.  Without giving the exact numbers, the Chinese report that the number of executions is down.

Far from the Facts

Due to a China Law Blog post, I spent the better part of an hour hunting for a quote from Sir Robert Hart where he compares China and England’s legal systems in the 19th century. In the quote, which I couldn’t find, Hart points out that the British and Chinese legal systems differ because of culture—one is based on the individual and China’s is not.

In I Wish All China Could be California Girls, Dan Harris (China Law Blog) mentions a post I wrote, Belching for China, and then he takes the topic further. Harris writes, “I agree with iLooks overall premise, but I am not so sure Hindrey’s article is the right one on which to go off, because it is neither simplistic nor jingoistic…”

To make his point, Harris provides better evidence written by a personal Injury lawyer, William Marler, who feels that China needs a few good lawyers and a legal product liabilty system similar to the US.

That is the last thing China needs. In my “opinion” many of America’s problems stem from a lottery ticket mentality and bumper stickers saying, “Go Ahead and Hit Me and Make My Day.”

Marler writes that executing a top food-safety official in China for taking bribes is not the way to solve problems in food safety. What Marler doesn’t understand is that removing a rotten egg from the carton is sending a message to the Chinese and they get it. The Chinese have punished convicted criminals like this for more than two thousand years—far longer than any Western culture. In fact, today’s China is far less brutal since 1976.

To strengthen his point, Harris uses evidence from Stan Abrams at China Hearsay, another lawyer who chastises Marler for getting his facts wrong.  

What I learned from Harris and Abrams was that people like Marler and Hindrey and their stereotypical “opinions” about China are examples of what many in America believe, which is usually far from the truth.

Conversation—Sung Dynasty Philosophy

China may be the only ancient culture that survived the spread of Islam and Christianity and managed to hold onto its identity.

“Guan-jiah,” Robert said, “before I came to China I read The Travels of Marco Polo. Do you know who he was?”

“No, Master,” Guan-jiah replied.

“He came to China from Europe more than six hundred years ago and served under Kublai Khan during the Yuan Dynasty. Polo wrote that Hangzhou was the finest and noblest city in the world.”

“Hangzhou was the capital of the Southern Sung Dynasty, Master,” Guan-jiah said. “I’ve heard it is beautiful. Sung philosophy says that we have the power in our minds to overcome our emotions.”

“Marco Polo believed it was God’s will that he came back from China so others in the West might know what he’d seen.” Robert turned to his servant, who was the last in line. “Do you believe in this Sung philosophy, Guan-jiah?”

“The Sung said that if you know yourself and others, you would be able to adjust to the most unfavorable circumstances and prevail over them.”

“That’s admirable, Guan-jiah. You never mentioned you were a scholar. If the Sung Dynasty was that wise, I want to see Hangzhou one day.”

“I am no scholar, Master, but I must believe in the Sung philosophy to survive. I have read and contemplated much literature. However, I am like a peasant and have never mastered calligraphy. It is a skill that has eluded me.”

“How old were you when you studied this philosophy?”

“I was eleven, Master, two years after I was sent to Peking.”

The Prince’s Garden

These photos were taken inside Prince Kung’s (1833-1898) palace and garden (once called Gongwangfu). This palace is in Beijing’s Beihai district. Prince Kung was Emperor Hsein Feng’s (1831-1861) younger brother.

As Inspector General for the Emperor of China, Robert Hart, known as the Godfather of China’s modernism, lived in the same hutong that Prince Kung lived in.  The Forbidden City was on the far side of Tiananmen Square.

Robert Hart, the main character in “My Splendid Concubine” and “Our Hart”, often met Prince Kung in this garden.

After 1950, for several decades, this palace and the garden became a communal home for many Chinese. In recent years, the garden, considered one of the best in China, was renovated and is now a tourist attraction, which attracts thousands of visitors daily.

To design a proper Chinese garden one must build a big place in a small space.  Prince Kung’s garden and estate is surrounded by a high wall and outside is Beijing.  Once inside, it is easy to forget that outside the walls is a crowded city. It was also easy for the Qing (Manchu) royals to forget about what was happening throughout China.
